SuperSocial Terms and Conditions

Please read these Terms and Conditions of Use ("Terms") carefully before using the services provided by SuperSocial, with registered office at Calle Magistral Domínguez, 23. 04008 Almería, Almería, Spain, and official contact at Ivansenkin@supersocial.es (hereinafter, "SuperSocial," "we," or "our").

These Terms constitute a legally binding agreement between you ("the user" or "you") and SuperSocial. By accessing, registering, or using any of our services, you agree to be legally bound by these Terms. If you do not agree with them, you must not access or use the services.

1. DEFINITION OF SERVICES

SuperSocial offers an AI-based SaaS platform that allows you to connect Instagram, Gmail, Outlook, Telegram, WhatsApp, and other channels through official integrations (Unipile, Meta Graph API, etc.) to automate conversations in direct messages, emails, and chats, manage a unified inbox, and deploy AI agents for support, sales, and lead qualification.

For the purposes of these Terms, the term "Services" includes:

  • The website https://supersocial.ai and associated domains
  • The platform's web functionalities (inbox, AI agents, automations, embedded helpdesk)
  • Integrations with Shopify, WooCommerce, BigCommerce, Odoo, and other platforms
  • Any content, software, features, or tools offered
  • Any electronic communication sent by SuperSocial

Access to certain features may be subject to a paid subscription, as stipulated in the Payments and Refunds section.

2. ACCEPTANCE OF TERMS

2.1. By registering on the platform or using any part of the Services, you declare that you have read, understood, and accepted these Terms.

2.2. You also accept our Privacy Policy, which is expressly incorporated into these Terms by reference. If you do not agree with any of these provisions, do not use our Services.

2.3. SuperSocial may modify these Terms at any time. We will notify you of any substantial changes by email or a notice within the platform. Continued use of the Services after such modifications implies your acceptance.

3. MINIMUM AGE AND ELIGIBILITY

3.1. To use SuperSocial, you must be at least 16 years of age.

3.2. If you reside in a jurisdiction where the legal age of majority is higher, you declare that you have authorization from your legal representative to use these Services.

3.3. SuperSocial reserves the right to suspend or delete any account if it has reason to believe it was created by a minor or in violation of these Terms.

4. IMPORTANT NOTICES AND SERVICE LIMITATIONS

SuperSocial uses artificial intelligence systems to automate conversations in direct messages, emails, and chats of accounts connected through official integrations. The responses generated by the platform are automated, may vary in tone, content, or accuracy, and are subject to the current technological limitations of artificial intelligence.

You acknowledge and accept that:

  • AI-generated responses do not represent professional advice or personalized commercial advice.
  • You are solely responsible for the content delivered through your connected accounts, even if it was automatically generated by the system.
  • It is your responsibility to review and supervise automated messages sent from your accounts.
  • SuperSocial does not guarantee specific results regarding sales, audience growth, or commercial performance.
  • The platform is an automated support tool that depends on the context of use, the quality of user content, and external commercial strategy.
  • SuperSocial is integrated with official APIs of Meta (Instagram), Google (Gmail), Microsoft (Outlook), and other platforms. However, it is not affiliated with, sponsored by, or endorsed by Meta Platforms Inc., Google LLC, Microsoft Corporation, or any other third-party provider.
  • Any changes to usage policies, technical limitations, or temporary blocks imposed by such platforms may affect the operation of the Services without SuperSocial having control over them.
  • The SuperSocial website may contain links to third-party resources, articles, or tools. These are provided solely for informational reference. We do not control or guarantee the availability, accuracy, or security of these external sites.

5. USER REGISTRATION AND ACCOUNT SECURITY

To use SuperSocial Services, you must register and create a user account on our website. During the registration process, you will be asked for accurate and current information.

You are solely responsible for maintaining the confidentiality of your access credentials. If you suspect that someone has accessed your account without authorization, you must notify us immediately at Ivansenkin@supersocial.es.

By providing your contact details to SuperSocial, you expressly accept and authorize us to contact you by phone or through messages to offer you commercial information, support, follow-up, or assistance related to the Services.

By connecting your accounts (Instagram, Gmail, Outlook, Telegram, WhatsApp, Shopify, etc.) to the platform, you authorize SuperSocial to generate and send automated messages on your behalf through such channels. You expressly accept that you are solely legally responsible for the content of those messages.

SuperSocial reserves the right to suspend or remove your access to the Services if suspicious, illegal, or Terms-violating activity is detected.

6. INTELLECTUAL PROPERTY AND DATA USE

All content on the SuperSocial platform is the exclusive property of SuperSocial or its licensors. You may not copy, distribute, modify, or reverse engineer the software.

SuperSocial grants a personal, limited, and non-transferable license to access the Services solely for legitimate commercial purposes related to your connected accounts.

By connecting your accounts, you authorize access to and storage of certain data necessary to provide the service: username, account ID, messages, followers, etc. This data is used only to automate and personalize the experience within the Services.

You may request deletion of your account and all associated data at any time, in accordance with our Privacy Policy.

7. PAYMENTS, RENEWALS, AND REFUNDS

SuperSocial offers monthly or annual subscription plans. Upon subscribing, payment will be automatically charged through Stripe, unless the user cancels in advance.

Payments are processed by Stripe and are made securely. The user agrees that the subscription renews automatically unless manually cancelled before the next period.

Purchases are non-refundable, except where required by law or due to a technical error attributable to the platform. Requests must be sent to Ivansenkin@supersocial.es.

Users in the European Union may withdraw from the contract within the first 14 days provided they have not substantially begun using the premium features.

8. CONDUCT RULES AND PERMITTED USE

The following is prohibited:

  • Using SuperSocial to send spam, misleading, offensive messages, or messages that violate Instagram, Gmail, Outlook, Telegram, WhatsApp, or other connected platform policies.
  • Automating interactions from fake or unauthorized accounts.
  • Sharing sexual, violent, discriminatory, or illegal content.
  • Performing scraping, reverse engineering, or replicating the software.
  • Interfering with the security, operation, or availability of the service.

You are solely responsible for any AI-generated content from your accounts. Misuse may result in immediate suspension without refund.

9. INDEMNIFICATION, WARRANTY DISCLAIMER, AND LIMITATION OF LIABILITY

You agree to indemnify SuperSocial against any claim arising from misuse of the service or automated content generated from your accounts.

The Services are provided "as is," without warranties of uninterrupted operation, accuracy, or specific results.

SuperSocial's liability is limited, in any case, to the total amount paid by the user in the last 12 months or $50 USD, whichever is less.

10. INTERNATIONAL USE, APPLICABLE LAW, AND DISPUTE RESOLUTION

SuperSocial operates under the legislation of Spain. If you reside outside this jurisdiction, you are responsible for complying with local laws.

Any conflict will preferably be resolved amicably. Otherwise:

  • Users outside the EU: arbitration or competent courts according to the chosen jurisdiction.
  • Users in the EU: may go to courts in their country and/or use the ODR platform: https://ec.europa.eu/odr

11. MISCELLANEOUS AND CONTACT

These Terms constitute the complete agreement between you and SuperSocial. If any clause is deemed invalid, the remaining provisions shall remain in force.

SuperSocial may assign this contract to another entity without prior notice. All communications shall be considered electronic and binding.
